1. I think the right to privacy can be reasonably read into the constitution and it would protect abortion (and all medicine in general). Of course, subject to regulation that can pass strict scrutiny.

  2. Whether or not I agree with the contention that citizens would have a right to privacy, I do, that doesn't justify the court reading it into the constitution. That's essentially giving 9 unelected individuals the ability to read whatever they want into law, that's not democratic, and it's certainly not how the independent judiciary was set up.

  3. "reasonable" to who? "never intended to be." then don't let 9 justices come up with new rights based upon what they believe is reasonable, and leave it to the legislatures. That's such a reductionist argument. Our constitution and legislature were two of if not the most democratic institutions in the world. There's room for nuance.

  5. And we've already discussed Obergefell and the right to privacy and marriage, or right to privacy and homosexuality in Lawrence. There is a long jurisprudential history of marriage's importance in society, that was the reasoning. The reasoning was not used nor exists in the case of abortion.

  6. Yes but then you're taking for granted that Obergefell used the right framing of the interest. Under your theory of what description we should be looking for in the Constitution to ground a right to abortion as concerned with particulars why shouldn't Obergefell or Lawrence have come out the other way in asking whether a right to homosexual or interracial marriage existed in Constitutional history? Why is the abstraction of the description as a general right to marriage justified in those cases when strict originalism would not be able to find historical support for the particular interests advocated for in those cases.

  7. What's the general interest in Lawrence? Intimacy. What's the general interest in Obergefell? Marriage. Under the constitution the court held these ARE fundamental rights because they are so ubiquitous in the history of American and European society, therefore they could not discriminate within these fundamental rights against same-sex couples. Wasn't based on Roe and Casey as you purport.

  8. This finals season has been pretty similar, I've compensated with way too much caffeine to get the ball rolling. If caffeine works for you, It's a sure thing. Also, try and mix up where you study. I find it helpful and refreshing to go to a new coffeeshop every no and again

The idea behind stare decisis is that the Supreme Court should not lightly revisit disputes it previously ruled on — even if new justices appointed in the interim would have decided those cases differently if they had been on the bench at the time — because stability serves the rule of law in and of itself.

  14. This question cannot be really answered until we get into the postseason. Look at Arkansas last season in the supers. They looked unstoppable all season even up to Game 2 of the super regional.

I'm just saying it's kind of silly for the players to have to bare all of the burden when Bianco has not established a consistent batting lineup, pitching rotation, infield positions or outfield positions. Yes we should be performing better but Bianco's dumb decisions have greatly hindered their ability to do so.

  18. Carter doesn't have the guts to fire Bianco, the only way I can see that happening is if we don't make a regional. But, I'm sure we'll squeak into a regional, overperform, then get knocked out in the supers like always

  21. I will say watching the TN/Vandy series, I feel slightly better about our bullpen. However, we’re living or dying with our bats, if we go cold like last weekend we won’t be able to compete come postseason

  22. Yes!! We hit really well against average pitchers but can't seem to hit anything when they are good.

  27. Bianco tried going to Omaha once, he didn't care for it, so he's making sure he never has to go back. We pay him a top 5 salary, and Omaha is a lot of extra work, but he'll make sure to lose in the Supers every other year to give the illusion of effort.
